HOW LONG DO I HAVE TO FILE A PERSONAL INJURY LAWSUIT IN ALABAMA OR FLORIDA?
If you were injured in an accident in Alabama or Florida, you generally have two years from the date you were hurt to file a lawsuit. If you don’t, your case is just gone. It doesn’t matter if the insurance company is dragging your claim out or making promises to pay and don’t. Once that date passes you have no case. If you file suit within the two year time limit your case will continue even if it takes years.
Examples of injury cases that have the two year time limit in Alabama and Florida include: Car accidents, tractor-trailer accidents, motorcycle accidents, slip and falls, and injuries caused by defective products. Medical malpractice is generally two years from the date of the malpractice but can be two years from when the malpractice is discovered. Wrongful death cases are two years from the date of death. Injury cases of minors can be extended until they turn 18. Florida has special time limits if you are injured by the government or someone injures you on purpose like during an assault that depend on the circumstances.
